On November 10, the regulatory modification came into force so that the municipal capital gain is legal and constitutional. This is the tax levied on the cadastral value of the property's land, and therefore it is essential for the real estate sector. Do you know the details?

1.The regulations adapt the tax to the ups and downs of the real estate market. Seeks that capital gains are paid only in the event that a home is sold or transferred when there has been a profit.
 
2. The taxpayer may choose the model that he considers most convenient. Two formulas can be used to calculate the tax base: A) Objective: apply some coefficients on the cadastral value based on the number of years that have elapsed since the sale or, B) Real: use the difference between the purchase and sale value.
 
3. The objective formula: the cadastral value of the property will be multiplied with new coefficients. Each year new coefficients will be approved that will evolve depending on the real estate market. It is an optional method, since the taxpayer can pay taxes based on the real capital gain obtained at the time of transfer of the property.
 
4.The real formula: it will be a calculation of the difference between the sale or selling price and the purchase or acquisition price of the property. If the taxpayer shows that the real capital gain is lower than that resulting from the objective estimation method, he may apply the real one.
 
5. If there has been no profit from the sale of the property, the payment will be exempt.
 
6. Municipalities will have six months to adapt it to their legal framework.
 
7. It is not retroactive.
 
8. Until now, no capital gains were paid for transfers made within one year between the acquisition date and the sale date. Now, the Treasury will also tax those situations to avoid speculation.
 
9. The new regulations guarantee that the tax is adapted to the real estate reality of each municipality.
